Pokermatic, Inc. ('Lightning Poker') has today announced that it has filed an action in federal court in Philadelphia against PokerTek, Inc.
Lightning Poker alleges that PokerTek has violated the antitrust laws and has engaged in various acts of unfair competition, civil conspiracy, trade slander and defamation to Lightning Poker’s customers.
PokerTek has allegedly been falsely advising Lightning Poker’s customers and potential customers that the sale or use of Lightning Poker’s dealerless electronic poker table infringes PokerTek’s issued design patent or pending published patent applications.
'We merely seek the right to compete fairly in the marketplace free from untrue comments to our customers that leads them to believe that the purchase or use of our product will result in some type of patent litigation,” said Brian Haveson, chairman of Lightning Poker. “We believe our innovative Lightning Poker product and strong intellectual property portfolio will enable us to gain a pre-eminent position in the marketplace.'
The suit seeks treble damages, attorney’s fees, an injunction against further acts of antitrust and civil conspiracy, as well as a declaration that Lightning Poker’s dealerless electronic poker table does not infringe a design patent owned by PokerTek.
